Welcome to MyShopZA. These Terms and Conditions ("Terms") govern your access to and use of the MyShopZA platform, website, mobile applications, and related services ("Platform"). By creating an account or using MyShopZA, you agree to be bound by these Terms.


1. About MyShopZA

MyShopZA is a South African Software-as-a-Service (SaaS) platform that enables businesses to create online stores, sell products and services, accept payments, manage customers, generate invoices and quotations, schedule appointments, and operate their businesses digitally.

MyShopZA provides technology services only and is not the seller of products listed by merchants using the platform.


2. Acceptance of Terms

By accessing or using MyShopZA you confirm that:

  • You are at least 18 years old or have legal permission from a parent or guardian.

  • You agree to comply with these Terms.

  • You agree to comply with all applicable South African laws and regulations.


3. Account Registration

You agree to:

  • Provide accurate and complete information.

  • Keep your login credentials secure.

  • Maintain updated business information.

  • Notify MyShopZA immediately of unauthorized account access.

You are responsible for all activity under your account.


4. Merchant Responsibilities

Merchants using MyShopZA agree to:

  • Sell products and services legally.

  • Maintain accurate product deions and pricing.

  • Deliver products as advertised.

  • Honour customer orders.

  • Comply with South African consumer protection laws.

  • Maintain required business registrations where applicable.

Merchants are solely responsible for:

  • Product quality

  • Inventory

  • Shipping

  • Refunds

  • Taxes

  • Customer support


5. Prohibited Activities

Users may not use MyShopZA to:

  • Sell illegal products or services.

  • Sell counterfeit goods.

  • Sell stolen property.

  • Promote hate speech or discrimination.

  • Distribute malware or harmful software.

  • Commit fraud.

  • Violate intellectual property rights.

  • Harass other users.

  • Circumvent platform security.

  • Engage in money laundering or other criminal activities.

MyShopZA reserves the right to suspend or terminate accounts engaging in prohibited activities.


6. Payments

Payments processed through MyShopZA may be handled by approved third-party payment providers.

Merchants acknowledge that:

  • Payment providers have their own terms.

  • Processing fees may apply.

  • Settlement times depend on payment providers.

  • Chargebacks remain the merchant's responsibility.

MyShopZA does not guarantee payment approval.


7. Pricing and Subion Fees

Subion fees:

  • Are billed monthly or annually.

  • Must be paid on time.

  • May change with prior notice.

Failure to pay may result in:

  • Suspension of services

  • Downgrade of features

  • Account termination


8. Free Trial

Where offered:

  • Free trials are limited-time promotions.

  • Trial features may differ from paid plans.

  • MyShopZA may modify or discontinue free trials at any time.


9. Orders

Customers purchasing from merchants acknowledge that:

  • Orders are placed directly with merchants.

  • Merchants are responsible for fulfilment.

  • MyShopZA is not responsible for delivery delays.

  • Product warranties are provided by merchants.


10. Shipping and Delivery

Delivery times vary depending on:

  • Merchant location

  • Courier availability

  • Public holidays

  • Weather

  • Inventory

Estimated delivery dates are not guaranteed.


11. Refunds and Returns

Refund policies are determined by each merchant.

Customers should contact merchants directly regarding:

  • Returns

  • Exchanges

  • Refunds

  • Damaged goods

Merchants must comply with applicable South African consumer protection laws.


12. Intellectual Property

All MyShopZA branding, software, graphics, logos, code, documentation, and platform features remain the intellectual property of MyShopZA unless otherwise stated.

Users retain ownership of the content they upload.


13. User Content

You grant MyShopZA a non-exclusive license to:

  • Display your store

  • Process uploaded content

  • Host your data

  • Generate platform previews

  • Deliver platform services

You remain responsible for all uploaded content.


14. Privacy

Your use of MyShopZA is governed by our Privacy Policy.

We are committed to protecting your personal information in accordance with applicable privacy laws.


15. Platform Availability

While we strive for continuous availability, MyShopZA does not guarantee uninterrupted service.

Downtime may occur due to:

  • Maintenance

  • Security updates

  • Internet outages

  • Third-party service interruptions

  • Force majeure events


16. Limitation of Liability

To the maximum extent permitted by law, MyShopZA shall not be liable for:

  • Lost profits

  • Lost sales

  • Business interruption

  • Data loss

  • Indirect damages

  • Consequential damages

  • Courier delays

  • Third-party payment failures

Our total liability shall not exceed the subion fees paid by you during the preceding twelve (12) months, unless otherwise required by law.


17. Indemnification

You agree to indemnify and hold harmless MyShopZA, its employees, directors, partners, and affiliates against claims arising from:

  • Your use of the platform

  • Your products

  • Your services

  • Violation of these Terms

  • Violation of applicable laws

  • Intellectual property disputes


18. Account Suspension or Termination

MyShopZA may suspend or terminate accounts if users:

  • Breach these Terms.

  • Engage in fraudulent activity.

  • Fail to pay subion fees.

  • Misuse platform services.

  • Violate applicable laws.

Users may close their accounts at any time, subject to any outstanding payment obligations.


19. Third-Party Services

MyShopZA integrates with third-party providers, including payment gateways, messaging services, and delivery partners.

We are not responsible for the availability, performance, or policies of third-party services.


20. Changes to the Platform

We may:

  • Add new features

  • Remove features

  • Modify pricing

  • Improve security

  • Update integrations

These changes may occur without prior notice where necessary for security or legal compliance.


21. Changes to These Terms

We may update these Terms periodically.

Continued use of the Platform after updates constitutes acceptance of the revised Terms.

These Terms shall be governed by and interpreted in accordance with the laws of the Republic of South Africa.
